Homestake — Terms of Service

1. The Service

Homestake is a personal knowledge tool. You submit links to content you wish to study — such as articles, newsletters, podcasts, videos, and PDFs — and Homestake uses automated and AI-powered processing to generate transformative outputs for your personal use, including summaries, key insights (“glints”), flashcards, chapters, and the ability to ask questions about that content.

Homestake produces transformative summaries and insights. It does not republish, redistribute, or make available the full original source text or transcript of the content you submit. Outputs are intended for your own personal knowledge use.

2. Eligibility and Your Account

• You must be at least 13 years old to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate information and to keep it current.
• Notify us promptly of any unauthorized use of your account.

3. Content You Submit

You are solely responsible for the links and content you submit to the Service and for any content you share through it. By submitting content for processing, you represent and warrant that:

• You have the right to access the content and to submit it for processing — for example, the content is publicly available, you own it, or you hold a valid subscription or license to it.
• Your submission and use of the resulting outputs comply with the terms of service, license terms, and other rules of the source from which the content originates.
• You will not use the Service to infringe the intellectual property, privacy, or other rights of any third party.

When you use any sharing feature — including sharing gold (highlights), sharing mines, or sending links to your processed content — you represent and warrant that you have the right to share that content and that doing so does not violate the original source's terms of service, copyright, or any other applicable restriction. You are solely responsible for ensuring that any content you share through the Service is content you are authorized to distribute in that form.

Responsibility for compliance with a source's own terms rests with you, the user — both when submitting content and when sharing outputs derived from it. You grant Homestake the limited right to access, store, and process the content you submit solely to provide the Service to you and to generate your summaries and insights.

4. Acceptable Use

You agree not to:

• Use the Service to reproduce, republish, or redistribute the full text or transcript of copyrighted source material.
• Attempt to extract verbatim copies of source content through the chat or any other feature in order to circumvent the transformative nature of the Service.
• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• Attempt to disrupt, overload, reverse-engineer, or gain unauthorized access to the Service or its underlying systems.
• Resell, sublicense, or commercially exploit the Service or its outputs in a manner not permitted by these Terms.
• Share, distribute, or make publicly available through the Service any content that you do not have the right to share, or in a manner that violates the original source's terms of service or applicable copyright law.

5. Credits and Payment

• Processing content consumes credits. Your plan determines your monthly credit allocation and any additional credit options.
• If a dig fails to process, the credits charged for that dig are automatically refunded to your account.
• Paid subscriptions are billed through Stripe. We do not store your payment card details. Subscription fees are billed in advance and, except where required by law, are non-refundable.
• We may change plan pricing or credit allocations; we will give reasonable notice of material changes that affect you.
• Referrals and affiliates: referral links may earn bonus credits for both parties. Separately, we operate an invite-only affiliate program whose participants earn cash payments for qualified signups and paid conversions at individually agreed rates. If you promote Homestake as an affiliate, you must clearly disclose the relationship where required (for example, tagging promotional posts with #ad per FTC guidance). US affiliates earning $600 or more in a calendar year must provide a Form W-9 for tax reporting. We may withhold or void payouts for self-referrals, fraudulent activity, or refunded purchases.

6. Intellectual Property

The Service, including its software, design, and branding, is owned by Homestake Digital LLC and protected by intellectual property laws. The outputs generated from content you submit are made available for your personal use. Source content remains the property of its respective rights holders; Homestake claims no ownership of it.

7. Third-Party Services

The Service relies on third-party providers — including Supabase, Stripe, Anthropic, Fly.io, and Vercel — to operate. Your use of the Service is also subject to those providers' terms where applicable. We are not responsible for the availability or practices of third-party services or of the external sources from which you submit content.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. AI-generated outputs may contain errors, omissions, or inaccuracies, and should not be relied upon as a substitute for the original source or for professional advice. We do not warrant that the Service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, Homestake and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that creates legal risk or harm to Homestake or others. Provisions that by their nature should survive termination — including ownership, disclaimers, and limitation of liability — will survive.

11. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
